UFC lightweight champion Sean Sherk, who was suspended after a failed drug test overseen by the California State Athletic Commission, has filed an extension with the athletic commission that will delay the appeals hearing, according to Sherdog.com.

Sherk’s appeal was originally set for today.

According to the report, Sherk will instead have his hearing held in October with the hopes of fighting B.J. Penn at UFC 78 on Nov. 17.

Sherk defeated Hermes Franca via unanimous decision at UFC 73, which took place July 7 at ARCO Arena in Sacramento, Calif. However, after the championship bout, both fighters tested positive for anabolic steroids and were promptly fined $2,500 and suspended one year by the CSAC.

Sherk was dinged for elevated testosterone levels and Nandrolone, an anabolic steroid. Normal levels of Nandrolone — which the body naturally produces — range from 2 ng/mL for an average person to 6 ng/mL for an athlete engaged in rigorous activity. Both Sherk’s “A” and “B” samples showed levels of 12 ng/mL, according to the CSAC.

Franca fessed up and said he took the steroids (Drostanolone) to speed up the healing process from an ankle injury.

Sherk, though, maintains his innocence, and in a statement he released after the failed test, said he was investigating possible causes of the failed test with his attorney.

Sherk has retained Los Angeles attorney Howard Jacobs, who’s represented some of the sporting world’s biggest names in doping cases.
